Fitness Plus Terms and Conditions of Membership, Rules, Regulations and Policies

Saint Francis Medical Center’s Fitness Plus is a medically supervised health, fitness and wellness facility developed, owned and operated by Saint Francis Medical Center. Fitness Plus has been established to meet the health, fitness, wellness and rehabilitation needs of its membership. By virtue of Fitness Plus membership, the member agrees to abide by all Terms and Conditions of Fitness Plus Membership and Fitness Plus Rules, Regulations and Policies.

Membership Qualifications

Subject to approval by Fitness Plus, without regard to race, sex, ethnic background or religion, any individual 16 years of age or older, of proven financial responsibility, is eligible for membership to Fitness Plus. Membership to Fitness Plus includes the member’s right to use the Fitness Plus facilities in accordance with these Terms and Conditions of Fitness Plus Membership and Fitness Plus Rules, Regulations and Policies, which may be amended from time to time. Membership does not confer any authority in the management of Fitness Plus or any interest in the property or assets of Fitness Plus. Memberships are non transferable.

Consumer’s Right to Cancellation

The member may cancel this agreement without penalty or further obligation within three (3) business days from his/her joining date. The member’s notice of cancellation must be in writing, signed and sent to Fitness Plus by certified or registered mail -or- by completion of the appropriate cancellation form (located at Fitness Plus), delivered in person to the Fitness Plus Administration Offce. The member must return with his/her notice of cancellation all agreements, documents or any other evidence of membership to Fitness Plus.

Membership Dues and Charges

Membership constitutes a contractual commitment to pay Fitness Plus dues until a 60 day cancellation notice is received after 12 consecutive months for an annual agreement or 60 days for a month to month agreement. Withdrawals from Fitness Plus, except for the detailed reasons listed under “Rights to Premature Cancellation”, will not relieve the member from fulfilling his/her obligation. Notice of cancellation must be in writing, dated, signed and sent to Fitness Plus by certified or registered mail or by completion of the appropriate cancellation form (located at Fitness Plus), delivered in person to Fitness Plus.

Rights to Premature Cancellation

The member may also cancel this agreement for any of the following reasons. Additionally, the member has a right to a prorated refund of monthly dues in the event that he/she paid for his/her annual membership in full and he/she cancels prematurely for one of the following reasons.

  1. If, upon a medical doctor’s written order, the member cannot physically receive the services because of significant physical disability, 60-day written notice from both the physician and the member is required.
  2. If the member moves his/her residence more than 40 miles from Fitness Plus and Fitness Plus cannot secure membership privileges at a comparable facility. Proof of new residency is required as part of the member’s 60-day written notice.
  3. If the member is deployed or called to duty in any of the recognized military services of the United States, proof of deployment or call to duty is required as part of the member’s 60-day written notice.
  4. If the member dies, his/her estate shall be relieved of any further obligation for payment under the contract not then due and owing.
  5. If the services cease to be offered as stated in the agreement.

Premature cancellation under items 1, 2 and 3 requires a 60-day written notice and will become effective on the last day of the month following the month in which the 60-day notice is received. Cancellation notification must be in writing, signed and sent to Fitness Plus by certified or registered mail -or- by completion of the appropriate cancellation form (located at Fitness Plus), delivered in person to the Fitness Plus Administration Office.

For reasons 1 through 3, the member may request that, in lieu of cancellation, the member be granted a leave of absence during which membership dues and privileges are temporarily suspended. Fitness Plus has sole discretion to grant a request or leave of absence.

Membership Category Changes

If the member is in good standing, he/she may add a spouse or family member to his/her individual membership at any time, thus altering his/her membership category. However, a change in category shall constitute an automatic renewal of his/her membership, which will alter the anniversary date accordingly. If the member is in good standing, he/she may assume a new membership category by removing a spouse or family member.

Fitness Plus Dues and Fees

Fitness Plus, at its option, may increase dues from time to time. The member will be notified at least 60 days prior to any increase in Fitness Plus dues. Dues will not be reduced during times when Fitness Plus is maintaining or renovating any of its facilities. Membership is payable annually or monthly through electronic fund transfer (EFT) of a personal checking/savings account or major credit card.

Revisions/Changes

The enrollment fees; yearly dues; charges; Fitness Plus Rules, Regulations and Policies and the Terms and Conditions of Fitness Plus Membership are subject to change by Fitness Plus management from time to time. The member may be notified of such changes in any manner which Fitness Plus management deems appropriate.

Payment Policies

If the member chooses to pay for membership monthly, he/she will be required to pay the appropriate one-time enrollment fee at the time of joining and monthly dues will be collected on the first of each month (in advance of the month services will be delivered) through an automatic EFT of checking/savings account or credit card. Monthly payments delivered in person to the Fitness Plus front desk prior to the last day of each month will negate the automatic EFT or credit card for the following month. The member may choose to pay for membership in full once annually. Fitness Plus will accept cash, check or major credit card in an amount equal to the full annual value of the appropriate membership category, including the one-time enrollment fee. Fees for programs, services and products may be paid for at the front desk with cash, check or major credit card. The member agrees to pay collection costs incurred by Fitness Plus in collecting any past due amounts, including court costs and reasonable attorney’s fees. The member also agrees to pay a $20 handling fee for any returned check.

Damages

The member is responsible for any damage to Fitness Plus property and/or property of other members and his/her guests caused by him/herself or his/her guests, except that due to ordinary wear or usage.

Suspension/Termination

Fitness Plus may terminate for cause any membership by mailing a notice in writing to the last address shown in the records of Fitness Plus for the member being terminated. The terminated member will be required to promptly return any Fitness Plus property currently in his/her possession. A terminated member will remain liable for all dues and other indebtedness incurred until his/her membership anniversary date. Use of Fitness Plus facilities is available only to members in good standing and their guests. A member in good standing is one who has no outstanding membership dues or Fitness Plus charges over 30 days old or has no reports of misconduct in his/her personal file. Fitness Plus will return all personal data obtained about a member to the member within 30 days after termination of the contract. Fitness Plus retains the right to maintain confidential copies of the personal data on file. A medical evaluation may be required for continued membership in the event a medical condition becomes apparent.

Sex Offender Policy

In the interest of maintaining an environment that is safe for members, employees and visitors, Fitness Plus prohibits access to its facilities and/or grounds to registered sex offenders. Any individuals known to be listed on any state or national sexual offender registry shall be denied access to Fitness Plus and any of its programs and/or events.

Changes to This Contract

Fitness Plus Membership Application and Agreement; Fitness Plus Rules, Regulations and Policies; and Terms and Conditions of Fitness Plus Membership are the entire agreement between Fitness Plus and the member. Any changes to these documents must be in writing and signed by management of Fitness Plus. In the event any part of these agreements are found in court to be invalid or unenforceable, such part shall be deemed stricken and the remainder of the documents shall remain in full force and effect. Failure to abide by these documents may result in termination of membership.

Leaves of Absence

The member may request a leave of absence from Fitness Plus by submitting a written notice received by Fitness Plus at least 60 days prior to the agreement anniversary date. A leave of absence may also be granted at any time as described in “Rights to Premature Cancellation.” If the member leaves Fitness Plus in good standing, the member will be readmitted to Fitness Plus without payment of an additional enrollment fee if the member reapplies less than three (3) years following the effective leave of absence. If the member left Fitness Plus in good standing, he/she will be readmitted to Fitness Plus within one (1) year following a grant of a leave of absence if the member pays an amount equal to all monthly dues which would have been due from the effective date of the leave of absence to the date of readmission. Any requests for readmission are subject to review and approval by Fitness Plus management.

Medical Freeze

In lieu of cancellation for medical reasons as stated above, the member may request a temporary medical freeze with a written order from the member’s doctor.

Senior Freeze Benefit

Members 55 years of age or older may freeze their membership once a year for a minimum of one calendar month and for a maximum of two calendar months while the member is residing more than 40 miles from home.

Cessation of Services

In the event that Fitness Plus closes the facility, Fitness Plus will be obligated to find a substantially similar facility that will assume the membership agreements or to provide the member with a prorated refund for the portion of services not received.

No Soliciting

Solicitation of any kind will not be tolerated at Fitness Plus.

Disclaimer

The activities and services by Fitness Plus are physical in nature and include risk of injury to oneself, from another member or in use of the facilities or equipment located in or outside the facility. The member understands and accepts these risks and agrees that neither Fitness Plus nor any agent, employee or person associated with Fitness Plus shall be held liable for any claims, damages or injuries to any individual arising out of the individual’s use of or presence at Fitness Plus.

Fitness Plus management reserves the right to change hours of operation.

Membership Number

Each member is issued a membership number. The member must enter his/her membership number at the Service Desk and be cleared by Service Desk personnel to gain access to Fitness Plus.

Guest Policies

Guests under 16 years of age must be accompanied by an adult member (18 years or older), must register, provide a photo ID and pay a guest fee at the front desk prior to using Fitness Plus. A guest is also required to complete a guest waiver. Unregistered guests will be asked to leave Fitness Plus immediately. Expelled or suspended members may not come as the guest of another member.

Dependent Usage

Dependents are persons 23 years or younger and still living in the same household. Dependents are extended membership privileges under the Family Membership category. All dependents will be issued a membership number, which must be entered at the Front Desk to gain access to Fitness Plus. Dependents ages 12 years and younger may use the track, Multipurpose Room, and pool during and must be accompanied by an adult while in the facility. An adult is defined as an individual who is 18 years of age or older assuming responsibility for a dependent while in Fitness Plus.

Dependents ages 13-15 may use the track, multipurpose room and pool and exercise equipment. Dependents 13-15 years old must be accompanied by an adult while in the facility unless participating in a structured Fitness Plus program. Fitness Plus staff reserve the right to require dependents older than the age of 8 to be accompanied by an adult based upon questionable swimming ability or disruptive behavior.

Cell Phone Policy

Cell phone use is limited to the following areas: lobby, track, seating area on the second floor and the multipurpose room. If using a cell phone in these areas, please be considerate to those around you and be aware of your surroundings so someone does not get hurt. Cell phones may not be used in speaker mode at any time. Cell phones are not permitted in the aquatics area, workout floor, group exercise studios or the locker rooms. If used in these areas it must be for emergency use only. Any call lasting longer than 30 seconds should be taken to an area where cell phone use is permitted.

Photography

Unauthorized photography by any devices is not allowed.

Emergency Procedures

Should an accident occur at Fitness Plus, immediately report it to the Service Desk by using one of the telephones located throughout the facility or notify any staff member. Emergency procedures will be expedited immediately. Should the member or a family member become injured while at Fitness Plus, Fitness Plus staff is not permitted to provide off-site transportation. All members are encouraged to be CPR certified.

Lost and Found

Fitness Plus is not responsible for items lost, stolen or damaged. Lost and found item inquiries should be made through the Fitness Plus Service Desk by calling 573-331-3355. Items of value will be turned into security at the end of the night. Items turned in and not claimed after 30 days will be donated to local charities.

Telephone

If the member wishes to receive a message while at Fitness Plus, check in at the front desk, where messages will be. Paging at Fitness Plus is used for emergencies only.

Fresh Healthy Cafe

Fresh Healthy Cafe, a health-oriented restaurant, is located off the lobby of the Health and Wellness Center. Fresh Healthy Cafe is available to Fitness Plus members, guests and the general public. The menu is designed to support health-oriented lifestyle changes that coincide with the total wellness concept being encouraged through Fitness Plus membership. Tasty selections that are reasonably priced and low in calories, sodium, cholesterol and saturated fat are available, making the nutritional component of the lifestyle transition convenient and enjoyable.

Day Lockers

The member is asked to respect Fitness Plus’ willingness to provide a daily locker service. Please do not bring valuables into Fitness Plus (or leave them in the provided lockers). Fitness Plus is not responsible for items lost, stolen or damaged. Please remove all personal belongings from lockers or items will be turned over to the lost and found. For those members not using facility locker rooms, express lockers are available in various locations throughout the facility. Rental lockers are also available.

Towels

The member is asked to respect Fitness Plus’ willingness to provide towels. This service is considered a privilege. If pilferage becomes excessive, this privilege will be revoked. Towels are the sole property of Fitness Plus.

Physical Activity Areas

Integration: Fitness Plus is an integrated facility, meaning all areas are shared by patients and members. Please be courteous and respect all patients and members.

Exercise Equipment Areas

  • Proper etiquette shall be enforced at all times. Horseplay will not be tolerated.
  • No food, gum or beverages (except water) shall be allowed in these areas.
  • No dependents under age 13 shall be allowed in the exercise equipment area.
  • An adult (18 years of age or older) must accompany dependents ages 13-15 while using equipment.
  • Please limit workouts on cardiovascular equipment to 30 minutes during peak hours.
  • Proper care and use of all equipment is the responsibility of each member.
  • Use of equipment is at the member’s risk.
  • Please be courteous by cleaning off equipment after use with the spray bottle and towel provided.
  • Please be safe! Ask Fitness Plus fitness staff for assistance.

Physical Assessment Room

  • The Physical Assessment Room has been established to provide accurate and professional assessments.
  • Lab equipment is not for the member to use unless under direct staff supervision.
  • All members are encouraged to go through a physical assessment and subsequent retesting.

Aquatics Area (Lap Pool, Recreation Pool and Therapy Pool)

The pools open at the time the facility opens and close one hour prior to the facility closing.

  • They are used for lap swimming, lessons, water exercise classes, and free swim. Pool scheduling is subject to change and often includes multiple activities at one time.
  • When a group exercise class is in session, the pool where the class is being held is closed to other activities and participants.
  • Anyone wishing to use the pool area is encouraged to shower first.
  • Members swim at their own risk.
  • Proper etiquette shall be enforced at all times. Horseplay will not be tolerated.
  • No diving will be allowed.
  • No food, gum or beverages allowed in area (water permitted).
  • Proper swimming attire is required.
  • Dependents 8 years of age and younger must be accompanied by an adult unless participating in an organized Fitness Plus youth program.
  • Members with open wounds or sores should not enter pools.

Fitness Plus staff reserve the right to require dependents older than the age of 8 to be accompanied by an adult based upon swimming ability, rule violations or disruptive behavior.

Warm Water Therapy Pool

Fitness Plus Members may use the warm water therapy pool when it is not being used for therapy. Therapy is typically between 8 am – 6:30 pm Monday – Friday.

Multipurpose Room

  • The multipurpose facility is used for a variety of scheduled activities and free-play activities. Unless specifically reserved, all members will be allowed access, with the limiting factor being facility capacity.
  • Proper etiquette shall be enforced at all times. Horseplay will not be tolerated.
  • No food, gum or beverages allowed in area (water permitted).
  • Due to special programming, the multipurpose facility may be reserved with notice from time to time. Advance notice will be posted when possible.
  • Dependents ages 8 years and younger must be accompanied by an adult unless participating in an organized Fitness Plus youth program.
  • Balls are provided, please use properly and return to the racks.

Fitness Plus staff reserve the right to require dependents older than the age of 8 to be accompanied by an adult based upon rules violations or disruptive behavior.

Group Exercise/Spinning Studios

  • Dependents age 13 years or older may participate in regularly scheduled aerobic classes.
  • Members and guests are required to wait outside the studios until the next class begins.
  • No food, gum or beverages allowed in studios (water permitted).
  • Proper etiquette shall be enforced at all times. Horseplay will not be tolerated.
  • Aerobic studio A/V equipment is for exclusive use of Fitness Plus staff.
  • Class participants are not permitted to enter a class after the initial 10-minute warm-up period.

Indoor Track

  • Track directions will change every day.
  • One mile is equal to eight laps (Cape) or eleven laps (Dexter).
  • Walkers and slow runners stay to the inside lane.
  • Fast runners stay to the outside lane.
  • Runners yield to walkers.
  • No food, gum or beverages allowed on the track (water permitted).
  • Proper etiquette shall be enforced at all times. Horseplay will not be tolerated.

Massage Waiting Area/Rooms

  • No food, gum or beverages allowed in massage areas (water permitted).
  • Members and guests are not allowed in the massage area unless they have a scheduled appointment.
  • Members and guests will enter through the appropriate locker rooms to access the men’s/women’s massage waiting area.
  • Proper etiquette shall be enforced at all times.
  • Disrespect to massage therapists and massage facilities will not be tolerated and will lead to discontinuation of Fitness Plus membership and membership benefits.

Sauna, Steam Room and Whirlpool Facilities

For the member’s safety, please follow posted guidelines at respective areas. All members and guests use these facilities at their own risk. An adult must accompany members and guests under 16 years of age. Proper dress required! Children under the age of 5 will not be permitted to use the “hot” areas.

Dress Code

The Fitness Plus dress code is designed to keep members and patients safe, protect equipment and provide a family-friendly atmosphere. Membership requires adherence.

Tops: All tops must cover the entire torso. Tank tops and sleeveless shirts are permitted as long as the armpit gap is less than the palm of your hand. Ripped-out sides are not permitted. Bras worn as tops are not permitted. There should be no more than a three-inch gap between top and bottoms. Tops with offensive graphics or language are not permitted.

Pants/Shorts: Athletic attire is preferred. Pants must be free of belts, studs, rivets or zippers as it could damage equipment. Pants/Shorts must cover the entire buttocks. Undergarments should not be visible.

Shoes: Athletic shoes are preferred; all shoes must be close toed and cover the entire foot on the workout floor, track, gym and group exercise rooms. Sandals, flip flops, heels and muddy shoes are not permitted in these areas. Shoes must be worn at all times outside the aquatics area.

Swim Attire: Swim attire is required when utilizing any of the pools. Swim attire must be conservative in nature, covering the entire chest (females) and buttocks. String bikinis and thongs are not permitted. No cut-offs or undergarment may be used as swim attire. A t-shirt worn over a swimsuit is permitted.
